1. Contractual Relationship & Corporate Underwriting
Welcome to GlobalFunda Academy (the "Platform"). These Terms and Conditions ("Terms") constitute a legally binding contractual agreement between you (referred to as "User", "Student", "Parent", "Guardian", or "Teacher") and UnLimited Konsulting Global ("the Underwriter", "We", "Us", or "Our"), the lawful corporate underwriter and operating owner of the Platform's digital assets, code repositories, and administrative architecture.
By completing the account registration process at /register, accessing any educational dashboard, or submitting any subject choices, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you are accepting these Terms on behalf of a minor student as their Parent or Legal Guardian, you assume full financial and legal responsibility for their actions and compliance across the Platform.
2. Automated Registration, Class Limits, and Enrollment Architecture
GlobalFunda Academy operates a proprietary, automated load-balancing enrollment engine designed to preserve small-group, high-impact learning. By using our system, you agree to the following structural enrollment mechanics:
- Fixed Allocation at Registration: Unlike traditional systems where students register and pick individual schedules later, a student is permanently assigned to their specific academic cohort the exact moment registration is completed and subjects are selected.
- Automatic Placement & Timetable Generation: The system takes the User's selected Country, Curriculum, Grade, and Subject parameters and instantly binds them to a unique Class Name/Number (e.g., *G10-MATH-ZA-04*). Concurrently, a finalized, time-zone-adjusted complete school timetable is generated and rendered immediately to the Student Dashboard.
- The Soft and Hard Capping Rules: Each virtual classroom container is strictly bounded to support between 12 and 15 students.
- When a class container reaches 12 students, the Class Manager is pinged to either seal the class immediately or permit growth up to 15 students.
- Once a class container hits the hard ceiling of 15 students, it seals automatically.
- The system will instantly spawn a new class container and pre-assign a qualified teacher to it. Students registering next will be routed to this new container automatically. Users have no right to manually demand transfers between sealed or open class cohorts.
3. Teacher Qualification, Assessment, and Engagement Rules
To maintain absolute educational quality underwritten by UnLimited Konsulting Global, all educators must strictly pass a dual-layered qualification gatekeeper before being allowed to interact with students or receive automatic class assignments:
- Highest-Grade Competency Benchmark: Teachers who choose to instruct multiple grades within a single subject (e.g., Mathematics for Grades 10, 11, and 12) are programmatically forced to write a comprehensive subject assessment *mapped explicitly to the highest grade selected* (Grade 12). Teachers must pass this automated test with a minimum score of 85%.
- Teaching Plan Evaluation: Teachers must compile and upload digital copies of their curriculum-specific Teaching Plans. These plans are routed directly to the Admin Manager via /admin-verification. The Admin Manager must evaluate and score this teaching plan above 85%.
- Verification Status: Full access to the Teacher Dashboard, automated class-spawning pools, and payment payouts is exclusively granted to profiles that have successfully cleared both 85% benchmarks and have been marked as "Verified" by the Admin Manager. UnUnlimited Konsulting Global reserves the absolute right to revoke a teacher's verification status at any point if instructional quality or professional conduct flags drop below baseline platform metrics.
4. Financial Terms: Fees, Automated Billing, and Currency Controls
- Payment Mandate: Access to the dynamic subject placement engine, Class Name/Number generation, and active timetables is strictly conditional upon the successful processing of tuition fees or subscription deposits as defined during the check-out funnel.
- Tokenization & Security: All transactional data processed via the platform is handled via secure, tokenized external payment gateways. UnLimited Konsulting Global processes electronic travel receipts and account balance sheets locally, but does not house raw credit card profiles.
- Currency and Time Zone Synchronization: While the school network operates across international timelines, processing currencies and core transactional protocols are pegged dynamically to the regional profile selected by the student during account setup.
5. Cancellation, Postponement, and Strict Refund Rules
Because GlobalFunda Academy's backend engine permanently locks student slots, reserves dedicated teachers, and restricts class containers from accepting other public applicants the moment you register, our financial policies are highly structured to prevent seat-spoiling:
- Cancellation Policy: A Parent or Guardian may cancel a student's enrollment at any stage via their Account Settings. However, processing a cancellation terminates active database allocations, clears their Class Name/Number assignment, and completely wipes their active compiled timetable.
- Strict Refund Restrictions: Due to the live, operational costs associated with maintaining small classes (12–15 student caps) and anchoring dedicated teachers from the point of creation, all fees paid are strictly non-refundable.
- Exceptions & Discretionary Credits: In exceptional circumstances (such as documented medical emergencies or severe, prolonged logistical disruptions), a User may submit a formal mitigation query to the Admin Manager. Any adjustment, class postponement, or account credit issued under these circumstances is granted entirely at the sole discretion of UnLimited Konsulting Global management and does not establish a permanent waiver of these Terms.
6. Codes of Conduct & Digital Classroom Rules
To ensure a safe, professional, and supportive synchronized learning environment, all users must adhere to strict behavioral rules.
A. Student and Parent Conduct
- Intimate Group Ethics: Because classrooms are limited to small groups, students must maintain polite, respectful, and collaborative interactions inside live chat systems and streaming frames.
- Academic Integrity: All assignments, homework uploads, and assessment evaluations submitted to dashboards must be the student's own work. Plagiarism or unauthorized utilization of automated tools to bypass learning checks will result in immediate suspension.
- Parental Supervision Responsibility: Parents and legal guardians are expected to monitor their minor ward's attendance patterns and review the system performance analytics dashboards regularly.
B. Teacher Professional Conduct
- Curriculum Compliance: Verified teachers must execute their live sessions strictly in accordance with the pre-approved Teaching Plans verified by the Admin Manager.
- Professional Boundaries: Teachers must interact with learners purely within the secure boundaries of the platform's synchronized classrooms, message routes, and dashboards. Any attempt to solicit private information or move student communication outside the Platform is a breach of contract resulting in immediate termination by UnLimited Konsulting Global.
7. Intellectual Property Rights
All digital assets, system frameworks, user interface text, algorithmic allocation scripts (including the soft/hard limit automated class-spawning triggers), logos, underlying codebase, and educational materials distributed across /curriculum paths are the exclusive intellectual property of GlobalFunda Academy or are fully underwritten and licensed by UnLimited Konsulting Global.
Users are granted a limited, non-transferable, revocable personal license to view, download, and utilize platform materials purely for personal educational development. You are strictly prohibited from copying, screen-recording, scraping, distributing, or commercially exploiting any content hosted within the global network without written authorization from management.
8. Limitation of Liability & Platform Continuity
- Elastic Scaling Downtime: While our platform utilizes state-of-the-art server arrays to hot-route students into new classes automatically, minor technical latency or scheduled system maintenance may occasionally occur. UnLimited Konsulting Global does not guarantee uninterrupted, flawless uptime and is not liable for temporary connection drops during live synchronous classes.
- Force Majeure: We are not legally responsible for any failure to fulfill our educational or hosting obligations if such failure is caused by regional power grid blackouts, infrastructure collapses, ISP failures, civil unrest, or global acts of nature beyond our realistic operational controls.
- Liability Cap: To the maximum extent permitted by applicable South African and international corporate law, the total collective liability of UnLimited Konsulting Global for any claims arising out of your use of the platform shall never exceed the total monetary amount actually paid by you to the platform over the three (3) months preceding the event that triggered the dispute.
9. Corporate Governance & Governing Law
These Terms are governed, constructed, and enforced in accordance with the corporate laws of the Republic of South Africa, where UnLimited Konsulting Global executes its administrative management, without regard to conflict of law principles. Any legal disputes, arbitration claims, or statutory actions arising from these terms will fall under the exclusive jurisdiction of the regional courts situated within the Gauteng province.
